ACTION AGAINST WEOBLEY WIGMORE RURAL DISTRICT
GROCER .
SUCCESSFUL DEFENCE AT HEREFORD COUNTY COURT .

At Hereford County Court on Tuesday a case came before Judge Tobin , K. C. , which a sequel to a recent action under the Workman's Compensation Apt , in which Henry Hebor Teague , auctioneer's assistant , 174 , Belmont Road , Hereford , was granted compensation at the rate of 10s . per week for injuries received in an accident arising out of and in the course of his employ at the Here- tord Poultry Market . The respondents in that action were Messrs . Barnsley and Davies . auctioneers and estate agents , Palace Chamb- ers , Hereford , and the third Party G. D. Manley , grocer , Weobley .
COUNCIL .
The monthly meeting of Wigmore Rural District Council was held on Tuesday . There Messrs . G. H. Green , T. J. Nott , J. Morgan , were present : Mr. L. L. Moore ( in the chair ) , B. Rogers , A. Thomas , W. T. Monnington , W. T. Morris , with H. T. Weyman ( Clerk ) , and A. Dunnings ( Surveyor ) .
The Clerk read the correspondence from the County Surveyor with reference to the excessive timber traffic over main roads 3 and 6 , also from the Road Stone Control Commit- tee with reference to supplies of stone for the roads in question .
The Medical Officer reported that the dist- rict was now practically free from infectious
diseases ..
The Clerk was requested to write to Mr.
Goodwin requesting the removal of the barbed wire from a footbridge near Paytoe , also to Mr. Edwards , of Elton , for the removal of a land slip on the main road at Elton ,
The respondents ( Messrs . Barnsley and Davies ) claimed to be indemnified by the third party against their liability to pay such com- pensation on the ground that the injury for which compensation was claimed was caused under circumstances constituting a legal lia- bility on his part to pay damages in respecting out of the watercourse near Paytoe , and
thereof .
Mr. Norman Birkett represented the Al liance Insurance Company , and made the ap plication , whilst Mr. Bosanquet , ( instructed by Mr. Harold Easton ) appeared for the third party .
Mr. Monnington again referred to the clean-

He further re- oprted that the well at Kinton had cleaned out and he was awaiting the report on the analysis of the sample of water sent for that purpose .

LORD RHONDDA'S PURCHASES . Much interest was taken in the sale of Mr. at Wickton Farm , Rowden Abbey . H. J. Bailey's pedigree Herefords on Thursday , Sir John Frank Russell was as successful as usual in Cotterell , Bart . , presided at the luncheon . Mr. the role of Auctioneer . attendance of buyers including new recruits . There was a large Wales , who again purchased freely . Lord to the ranks of Hereford breeders , from South Hereford herds in existence , was an important Rhondda , who is building up one of the purest purchaser , investing in four animals at an average of 102 guineas . The fifty - eight animals sold realised £ 3,109 1S . , an average price of over £ 53 .

Mr. Birkett said that on March 21st this year a sale was being conducted by the res- pondents at the Hereford Poultry Market , and the man who obtained compensation in the original proceedings , Mr. Harry Hebor Teague , was in their employ as porter and bailiff . On that particular day he was engaged in pen- ning lots of poultry . Among those who ar rived was Mrs. Manley , the wife of the third She loosed the reins and jumped out party . She left in the trap a young of the trap . lady . Miss Grout . Just behind the trap there an iron pillar concreted to the ground . Teague went to the back of the trap to un- load , and just as he got there the young lady pulled the reins tight , with the result that the spirited horse backed the trap on to Teague against the pillar . People shouted to the young lady to loose the reins . Teague was hurt , and the horse backed to the pens before there were no coal retailers actually within Rowden Starlike 28th , Captain E. L. A. it was pulled out . Special Constable Osborne heard the shouts , and saw the horse backing . It was a restive , high - spirited horse , and the young lady was pulling the reins . The con- stable , after the accident , said to her " What made you pull the reins ? " and she replied , " I don't understand horses . " There was another accident with the same horse the was deferred . same day . He submitted that the accident was caused through the negligence of the third party or his agent .

Special Constable Osborne , of 50 , Ledbury Road , said the girl had hold of the reins very tightly , and he told her to let go the horse's head . She said she did not understand horses , and he told her she should have got down and held the horse's head . When Mrs. Man- ley came she said she knew the horse was res tive . He thought the young lady looked a little flurried .
This concluded the case for the plaintiffs . George , Manley , grocer , Weobley , stated that he bought and sold poultry , and that depart- ment was managed mainly by his wife .

attended the market on March 21st , and he approved of her going . The trap belonged to him , but the horse was borrowed . It be- longed to Mr. Reynolds .
Cross - examined : He had driven the horse himself , and had left it outside houses unat- tended . The horse was sold by Mr. Reynolds . before the accident .
Mrs. Manley said when she went to the market she pulled up just inside to pay toll . One vehicle was in front and one behind . The trap had stopped before she alighted . Site unloaded the poultry , and after she had passed the horse she heard a noise . She saw the horse backing . Special Constable Osborne came up and said something , but she could not say what it was because of the noise . She had driven , the horse for six months , and it had always been quiet . When leaving the market she led the horse . She had been to Hereford . market once before . The horse was frightened by the noise made by the poultry . Cross - examined : She had perfect control of the horse . She had no recollection of a She conversation with the special constable . could not have said the horse was restive , be- cause it was not restive . Miss Edith Grout , of Weobley , who was given the reins by Mrs. Manley , said she did not pull them consciously . Her recollection was that her bands tightened on them , and might have pulled them tight .

On Monday morning a sad case of suicide was discovered at 41 , Mill Street , the residence of Mr. Arthur Ashton , aged 43 years , of in- Ashton was found in the bathroom with a razor in his hand and his throat cut . Assis- tance was called and Mr. T. Bryan went to him and after struggle obtained the razor . Dr. Mills was called , but the injuries proved Deceased was well known in Ludlow . 27 fatal . His name was formerly Arthur Davies , but he took the name of Ashton which is a fam- ily when inheriting some property . Deceased was the only son of the late Captain Ernest Davies , of the firm of Anderson and Davies , solicitors , who was Captain of the Ludlow Company of the 1st Shropshire R.V. He was a grandson of the late Major Rodney Anderson and nephew of Mr. Ashton Ander-

Henry John Sparey , baker and grocer , of Presteign , was charged with selling otherwise than by weight to one Mrs. Parsons at Lingen 9 loaves of bread on the 23rd of September . Defendant was further charged with delivering bread when not having with him proper scales or balances for weighing the same .
Defendant , who did not appear , wrote to the Bench that owing to his usual van man being laid up with a broken leg and a num- ber of his staff having joined up , he was de- pendent in a large measure on what casual assistance he could obtain .
